The profession of property manager comprises three major areas of responsibility: commercial, technical and legal activities. What does a property manager do? Commercial tasks at a glance

The commercial area is the most extensive block in a manager's everyday work. Month after month and year after year, tasks arise that without professional support quickly become a full-time job for owners.

Monthly rent collection and owner reporting

The manager collects the rent monthly, transfers the net income to the owner's account and creates a monthly report with an income-expenditure overview. If payments are missing, they handle the dunning process. For condominium owners' associations, they also bill the house fee and pursue arrears up to judicial enforcement.

What does a property manager do for utility cost billing?

The operating cost statement is one of the most legally demanding tasks in property management; formal errors regularly have legal consequences here. According to § 556 para. 3 BGB, it must be available within twelve months after the end of the billing period. Errors in the allocation or missed deadlines can mean that subsequent claims against tenants lapse. In addition, there is the annual overall statement with complete document verification for the owner.

Business plan and reserve management for WEG

For condominium owners' associations, the manager creates an annual business plan that sets the house fee amount and all planned expenditures. They manage the maintenance reserve and propose adjustments when foreseeable major repairs require a higher reserve. Without this plan, the association lacks the financial basis for every investment decision.

Technical tasks: Maintenance, monitoring and tradesperson coordination

Technical activities are often underestimated by owners because they take place in the background. Yet they are a central component of all property management activities and directly influence the value retention of a property.

Regular inspections and system monitoring

The manager monitors technical systems such as heating, lifts and fire protection equipment and conducts regular inspections. Statutory duties under § 27 WEG

Under § 27 WEG, the manager is obliged to implement resolutions of the owners' meeting, maintain the property in good condition and represent the association both in and out of court. They must demand outstanding payments from owners and, if necessary, file suit. Preparing, conducting and following up the annual owners' meeting is also one of their core duties. Under § 666 BGB, they are also obliged to provide complete information and accountability; owners have the right to inspect all management documents at any time.

Manager's duties in tenancy law

In rental management, the manager acts as the landlord's representative: they communicate with authorities and utility companies, monitor notice periods and issue legally compliant utility cost statements. Important for landlords: the costs of property management itself may not be passed on to tenants. They are borne solely by the owner and cannot appear as operating costs in the statement.

Letting and tenant search as an independent area of responsibility

Vacancy costs money. One of the most important project-related tasks of property management is therefore re-letting, from the first advertisement to the handover of keys.

From the listing to the signed tenancy agreement

The manager creates and places advertisements, coordinates and conducts viewing appointments and draws up the tenancy agreement in a legally compliant manner. All communication with interested parties runs through them, so that the owner is relieved. They also manage all incoming application documents and handle the pre-selection of suitable prospective tenants.

Credit check, handover and move-out protocol

Before a new tenant moves in, the manager checks their creditworthiness. On move-in, a detailed handover protocol is drawn up that bindingly documents the condition of the apartment. On move-out, a renewed inventory is taken: damage is clearly recorded and can thus be settled via the deposit. Without this documentation, enforcing claims for damages in court becomes difficult.

The three most common questions from owners looking for a manager for the first time: What does it cost? Who is even allowed to do this? And what happens if something goes wrong?

Typical management fees for residential and commercial properties

Fees vary depending on the type of property and the size of the complex. The following benchmark values apply as a guide for the German market (without guarantee; current market prices may vary depending on region and provider):

  • Rental management: 5 to 8 percent of the gross rent or a flat rate of 20 to 35 euros per unit and month (net); for smaller complexes, minimum flat rates often apply
  • WEG management: 18 to 35 euros per unit and month (net); in the Ruhr region and NRW, market prices for medium-sized properties are typically around 25 to 30 euros gross
  • Commercial properties: 3 to 5 percent of the gross annual rent or 30 to 60 euros per unit and month

Smaller complexes generally pay more per unit than large properties because the fixed cost share per unit is higher. For a WEG with fewer than ten units, monthly flat rates of 40 to 60 euros per unit are common on the market. For publicly subsidised housing in NRW, legally fixed management cost flat rates apply in accordance with the relevant funding regulations of the state.

IHK certification and professional liability insurance as quality features

Since 1 December 2023, WEG owners' associations can demand a "certified property manager (IHK)". According to the IHK examination regulations, the examination consists of a written part (90 minutes, PC-based) and an oral examination interview (at least 15 minutes). Exempt from the examination requirement are fully qualified lawyers, real estate agents with completed vocational training, certified real estate specialists (IHK) and university graduates with a focus on real estate.

In addition to certification, professional liability insurance is legally required for commercial managers (§ 34c GewO in conjunction with the Broker and Developer Ordinance). The statutory minimum coverage amounts are 500,000 euros per claim and 1,000,000 euros per insurance year. Anyone who does not meet these minimum standards risks personal liability in the event of breaches of duty, in individual cases also with their private assets. All commercial property managers are also obliged under § 34c GewO to demonstrate at least 20 hours of further training within three years.
