I'm Marcus Wellhöner – estate agent, property manager and founder of this family business. What fascinates me about listed heritage properties? They are not simply properties. They are witnesses to their era, built with craftsmanship and character that can no longer be produced in the same way today. Anyone who steps into such a house feels the history – and, at the same time, the responsibility to preserve it for future generations.

Check Subsidies for Listed Heritage Properties Early

Preserving and modernising a listed heritage property can involve considerable additional expense. Depending on the property, its use, location and the planned works, different subsidy programmes may be available. These include in particular the heritage subsidy of the State of North Rhine-Westphalia, municipal programmes, funding opportunities from the German Foundation for Monument Protection (Deutsche Stiftung Denkmalschutz), and programmes from KfW or BAFA for energy-related measures.

Whether and to what extent a subsidy is possible must always be assessed on a case-by-case basis for the specific property and works. The right timing is particularly important: subsidy options should be clarified before any execution-related contracts are signed or work begins.

Submit the Subsidy Application Before Work Begins

For many subsidy programmes, the application must be submitted, or already approved, before the so-called start of the project. Depending on the programme, even signing an execution-related supply or service contract can already count as a subsidy-damaging start of works. This is why eligibility, the application route and the required documents should be checked before craft or construction services are bindingly commissioned.

If a heritage-law permit is required for the planned works, it may form part of the subsidy documentation. A subsidy cannot be guaranteed; the decision on the application rests solely with the relevant funding body.

NRW State Heritage Subsidy

The State of North Rhine-Westphalia can support measures for the repair, preservation, securing or uncovering of listed monuments in particular. Support is mainly available for heritage-related additional costs. Approval is decided within the framework of available budget funds.

Municipal Subsidy Programmes

Depending on location, supplementary municipal subsidy programmes, grants or special programmes for redevelopment, heritage or urban-development areas may exist. Availability and requirements differ from municipality to municipality.

German Foundation for Monument Protection

The Deutsche Stiftung Denkmalschutz mainly supports qualified measures for the long-term preservation of original historic fabric. Funding requires, among other things, careful planning and execution in keeping with heritage conservation standards.

Energy-Related Subsidy Programmes

For energy improvements, programmes from KfW, BAFA, NRW.BANK or other funding bodies may be available. For a listed building, energy requirements and heritage conservation concerns must be coordinated with particular care.

Coordinating Subsidies and Tax Benefits

Subsidies and tax benefits can generally complement one another. However, the same expenses may not be taken into account more than once. Public grants can reduce the costs on which a tax benefit under §§ 7i, 10f or 11b of the German Income Tax Act (EStG) is based. What effect a subsidy has on tax treatment in a specific case must be clarified with tax advice and the relevant tax office.

From Heritage-Law Permit to Tax Certificate

The tax advantages of a listed heritage property do not follow from its listing alone. What matters is that planned works are coordinated with the relevant heritage authority before they begin, that the required permits are obtained, and that the works are carried out in line with the agreed requirements.

We coordinate the required documents, align all parties involved, document official requirements and, once the works are complete, prepare the cost and invoice documentation for the application to issue the tax heritage certificate.

Check Subsidy Eligibility Before Commissioning

Before execution-related contracts are signed, we check whether grants, subsidised loans or other subsidy programmes are available for the planned works. This assessment must be coordinated in good time with the heritage-law process and the works planning.

Assess the Works and Heritage Significance

Before works begin, it is clarified which building elements and measures affect the heritage value and which heritage-law requirements need to be considered.

Early Coordination

The planned works are coordinated with the local heritage authority and the specialist planners involved. This coordination before works begin is essential for the later certificate.

Obtain the Required Permit

Alterations, changes of use or other heritage-relevant interventions may require a permit under § 9 DSchG NRW. The permit is issued exclusively by the relevant authority.

Document Execution and Changes

The works must be carried out in line with the agreed requirements and official specifications. Deviations or subsequent changes must be coordinated again before they are carried out.

Prepare Invoices for Review

Once complete, invoices, proof of payment and costs are organised by measure, building element and trade. Not every approved expense is automatically eligible for a tax certificate.

Prepare the Certificate Application

On request, and within the scope of appropriate authorisation, Wellhöner prepares the documents for the application to the relevant heritage authority. The certificate issued then serves as the basis for the tax review by the tax office.

Permit and Tax Certificate Are Two Separate Reviews

A heritage-law permit does not automatically confirm that all costs are tax-privileged. After completion, the heritage authority reviews which coordinated and actually executed works are, by nature and scope, eligible for certification. The tax classification and recognition is then decided solely by the relevant tax office. Wellhöner provides organisational support and documentation, but not legal or tax advice.

§ 7i EStG

Enhanced deductions, in particular for let or commercially used listed buildings.

§ 10f EStG

Special expenses deduction for listed buildings used for the owner’s own residential purposes.

§ 11b EStG

Spreading of certain maintenance expenses for listed buildings.

Which provision applies in an individual case, and to what extent expenses can be taken into account for tax purposes, must be clarified with qualified tax advice and the relevant tax office. The responsibility of the local heritage authority for issuing the certificate follows from § 36 DSchG NRW.

Deduct Renovation Costs from Your Taxes

The heritage protection AfA (§§ 7h, 7i EStG – enhanced depreciation under the German Income Tax Act) is one of the strongest tax incentives offered by German legislation. Anyone who acquires a listed heritage property in need of renovation can spread the renovation costs as a tax deduction over 12 years – and indeed up to 100%.

Put simply: the state contributes to the cost of preserving a listed building – because these buildings safeguard cultural heritage and their renovation is considered socially desirable.

In the first eight years, you can deduct 9% of the renovation costs each year.

In the following four years, a further 7% is deducted from taxable income each year.

In total, up to 100% of the renovation costs can be claimed for tax purposes.

A Practical Example

Suppose you purchase a listed Gründerzeit-era house and the renovation costs amount to €200,000. Here is how the deduction is spread:

Years 1–8

9% × 8

= €144,000

Years 9–12

7% × 4

= €56,000

= €200,000

At a personal tax rate of, say, 42%, this results in an actual tax saving of around €84,000 – spread over 12 years. In effect, the renovation therefore costs you considerably less than it might appear at first glance.

Note: This is a simplified example for illustration purposes. The actual deductibility depends on your individual tax situation. We work together with tax advisors and are happy to refer you to qualified partners.

Key Requirements
  • The building must officially be listed as a protected heritage building – certified by the responsible heritage protection authority.
  • The works must be certified by the authority before construction begins – renovations deducted retroactively are not possible.
  • Only the renovation costs that serve to preserve or restore the protected heritage fabric are deductible – not the pure acquisition costs.
  • In the year the works are completed and for the following 10 years, the property must be used to generate income – for example, through letting.
